These Terms of Service ("Terms") govern your use of the KaiCore managed email outreach service ("Service") operated by KaiCore ("we", "us", "our"). By purchasing or using the Service, you ("Client", "you") agree to these Terms.
KaiCore is a managed B2B cold email outreach service. We configure, deploy, and operate an AI-powered email system on your behalf. This is a managed service, not a software license. You do not receive access to the underlying codebase. You receive access to a client dashboard to view leads, email performance, and campaign status.
The Service operates exclusively within the United States under CAN-SPAM regulations. We do not support outreach to prospects in the European Union (GDPR), Canada (CASL), or other international markets. The Service targets B2B companies with 5-50 employees. We reserve the right to decline campaigns targeting industries or audiences outside our operational scope.
The Service is limited to a maximum of 100 active clients at any time. Acceptance is not guaranteed. When at capacity, prospective clients are placed on a waitlist and notified when a spot becomes available.
During Weeks 3-4 of onboarding, we present you with your first batch of 20 AI-scored leads before any cold emails are sent. If the lead quality does not meet your expectations after reasonable targeting adjustments, you may terminate the Service at that point.
In this case, your monthly fee will be refunded in full. A portion of the setup fee ($248.50) will be retained to cover DNS configuration, domain setup, and warm-up work already completed. The remaining $248.50 of the setup fee will be refunded.
This guarantee applies only during the initial onboarding period (Weeks 3-4) and only before the first cold outreach emails are sent.
Lead data generated through the Service belongs to you. You may request a full data export at any time via the client dashboard or by contacting us. Exports are provided in CSV format and include all lead records, email history, and engagement metrics. Upon termination, we will provide a final data export within 14 business days.
We retain operational data (system logs, aggregate performance metrics) for internal use. No individual client data is shared with other clients or third parties except as described in our Privacy Policy.
We do not guarantee specific results. Open rates, reply rates, positive reply rates, and conversion rates vary by industry, target audience, value proposition, and market conditions. Past performance of other clients is not a guarantee of your results.
The Service is provided "as is." We make no warranties, express or implied, regarding the suitability of the Service for your specific business needs.
To the maximum extent permitted by law, KaiCore's total liability for any claims arising from or related to the Service is limited to the total fees paid by you in the three (3) months immediately preceding the claim. In no event shall KaiCore be liable for indirect, incidental, special, consequential, or punitive damages.
